Standard of Work
All work shall be completed in line with BS3998 (Recommendations for Tree Work) where appropriate unless instructed otherwise by the customer. We shall undertake the work in a competent manner in compliance with the specification and price contained within our quotation.
Acceptance of the Contract and Programming of the Work
All customers are entitled to a 14-day cooling off period following acceptance of the quotation. When you accept the quotation, we will start the work planning process which may include dealing with permissions from the Local Authority or other statutory bodies. We will advise you of the estimated completion date for your work.
If works are requested to commence within the 14-day cooling off period, the customer agrees that they waive their right to cancel once works, planning, administration or applications have commenced.
In the event of a cancellation, we may charge a percentage of the quotation to cover any preparatory work already undertaken and any costs already incurred.
Amendments to the contract must be made in writing.
Variations to the Contract
Variations may include amendments to the agreed specification, changes in site or ground conditions, additional works requested during operations, revisits to site, aborted visits, delays caused by third parties, restricted access, hidden defects, or any circumstance materially affecting the agreed scope of works.
Any variations may result in additional charges. No additional charges shall be applied without first seeking customer acceptance.
Performance
Work crews shall arrive at the work site at a mutually agreed date and time. Due to the nature of the work, we can only provide exact arrival times if you are the first job of the day. Consecutive appointments will depend on work progress and therefore only an estimated time of arrival can be provided.
Beechwood Trees and Landscapes Ltd shall attempt to meet all performance dates but shall not be liable for delays caused by weather conditions, site restrictions, traffic issues, breakdowns, utility restrictions, force majeure events, labour shortages, fuel shortages, road closures, third-party delays or any other circumstances beyond our reasonable control.
Where teams attend site and works cannot proceed safely due to weather conditions or circumstances outside of our control, aborted attendance charges may apply.

Complaints Procedure
In the unlikely event that you have any cause for complaint please contact the office within 24 hours of work completion, otherwise the contractor reserves the right to charge additional fees for further works, attendance, amendments or revisits.
We will endeavour to correct the situation in a timely manner.
Please be reassured that as a TrustMark registered company we offer an alternative dispute resolution (ADR) service to our customers.

When Do I Pay?
When the job is completed, the team leader will ask you to sign the job sheet to confirm your satisfaction. Please only sign this when you are satisfied that all items are completed. Please raise any queries with the team leader or the office before signing the job off.
The office will invoice signed-off jobs within 2–3 days.
All contracts and instructions are accepted based on payment of the full invoice value within 7 days of the invoice date unless otherwise agreed in writing.
A service charge of 1.5% may be added to accounts not fully paid 30 days subsequent to the invoice date.
We reserve the right to charge statutory interest and compensation pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 together with any recovery costs, solicitor’s fees, court costs or associated expenses incurred in recovering outstanding monies.
For larger contracts, Beechwood Trees and Landscapes Ltd may require a deposit or staged payments. Where applicable, Value Added Tax (VAT) shall be charged at the current rate.
Business-to-Business Customers
Where applicable, we will not commence works until an official purchase order number has been received.
Where a purchase order system is not used, the customer agrees to settle invoices strictly within agreed payment terms.
Should additional administrative procedures, certification requirements, approval processes or third-party systems be introduced after commencement of works, Beechwood Trees and Landscapes Ltd reserves the right to charge additional administration costs at £50.00 per hour.
Disposal of Waste
Most customers require removal of all arising waste material from site and this will normally be specified within the quotation.

Woodchip may be left for mulch upon request. Timber may also be left for firewood but is not normally left in sizes ready for burning unless specified in the quotation.
All timber, arisings and waste material remain the property of Beechwood Trees and Landscapes Ltd unless otherwise agreed in writing.
Stumps
When tree felling we will fell the tree to a stump as close to ground level as possible without making contact with the soil. This may be restricted if the stump is contaminated with metal, stone or other obstructions that could damage cutting equipment.
Stump Grinding (If Quoted For)
Stump grinding is normally carried out within a few days of the felling rather than on the same day. We will arrange a convenient time to undertake this work.
Stump grindings will normally be used to backfill the resulting hole as they decompose rapidly. The chippings can be removed from site at additional cost.
We will grind the main stump and major lateral roots within the immediate stump area. We will not chase every root unless specifically agreed and costed beforehand.
If during stump grinding we uncover asbestos, suspected asbestos, buried waste or other hazardous materials, works will cease immediately. The customer agrees to settle the invoice in full in accordance with our payment terms and any specialist clearance costs shall remain the responsibility of the customer.
Ownership and Permissions
The client warrants that all trees, plant material and property upon which work will be performed are owned by the client or that permission has been obtained from the owner.
Beechwood Trees and Landscapes Ltd accepts no liability arising from the client’s failure to obtain appropriate permissions.
Neighbouring Properties
Sometimes it is necessary to access neighbouring land, particularly where branches overhang boundaries. It is helpful if neighbouring owners are informed in advance.
Where access to neighbouring land is required, it is the customer’s responsibility to obtain written permission prior to works commencing.
Site Conditions and Access
The contract price is based upon the site conditions observed at the time of quotation.

Beechwood Trees and Landscapes Ltd reserves the right to apply additional charges or postpone works where site conditions differ materially from those originally inspected.
The work area must be accessible and free from hazards before work commences.
For health and safety reasons, areas must be free from animal waste, hazardous materials, aggressive behaviour, obstructions and unsafe conditions.
If works are delayed, postponed or aborted due to restricted access, vehicles not being moved, locked gates, unsafe conditions, tenant refusal, neighbour obstruction or similar circumstances beyond our control, additional charges may apply.
Protection of Lawns, Surfaces and Property
Whilst our staff will operate with care and diligence, tree works naturally involve the movement of timber, machinery and arisings across lawns, driveways and garden features.
Please ensure fragile or valuable items are removed or adequately protected prior to our arrival.
Lawns may become marked during wet weather conditions. Protective ground boards can be provided but may incur additional cost.
The site will be left generally clean, tidy and safe, however due to the nature of tree work it may not appear exactly as it did prior to commencement. Sawdust, woodchip, twigs, leaves, footprints and minor surface disturbance are unavoidable consequences of tree operations.
Artificial Grass
Artificial lawns can be damaged by heat, friction and mechanical equipment including chainsaws, hedge trimmers and tracked machinery.
We will not undertake works over or immediately adjacent to artificial lawns unless discussed beforehand and appropriate protection measures agreed.
Where protective measures are not agreed, no liability shall be accepted for damage to artificial grass surfaces.
Crown Reduction
This operation reduces the overall size of the crown. To avoid ambiguity, the specified end result will be stated either as the remaining tree height and branch spread or the equivalent average reduction in branch length.
Crown Thinning
In crown thinning, an even density of foliage is removed to create a well-spaced and balanced branch structure.

The percentage of foliage removed shall be kept to the minimum required to achieve the objective and should not exceed 30% unless otherwise specified.
Crown Lifting
Crown lifting ensures the canopy clears the ground to an agreed height and that epicormic growth below that height is removed.
Permissions and Statutory Restrictions
Trees may be protected by Tree Preservation Orders, Conservation Area status, Forestry Commission controls or other statutory legislation.
Upon acceptance of our quotation, we shall check for legislative protection where appropriate.
Applications for permissions can be made on the customer’s behalf, however additional charges may apply subject to prior agreement.
The customer remains responsible for private covenants, planning restrictions and ownership matters. Wildlife and Ecology
Works may be constrained by ecological and wildlife legislation including:
● Wildlife and Countryside Act 1981
● Countryside and Rights of Way Act 2000
● Conservation of Habitats and Species Regulations 2017
Works may need to be delayed, modified or postponed due to nesting birds, bats or other protected species.
Beechwood Trees and Landscapes Ltd reserves the right to implement biosecurity measures and operational controls in response to tree diseases, pests or environmental risks.
Tree Planting and Plant Failures
We endeavour to obtain quality nursery stock compliant with BS3936.
Trees and shrubs require ongoing watering and maintenance following planting. Failures due to weather, vandalism, neglect, drought, ground conditions or circumstances beyond our control shall not be replaced unless specifically agreed.
Beechwood Trees and Landscapes Ltd accepts no responsibility for the ongoing maintenance or wellbeing of living plant material after practical completion unless covered under a separate maintenance agreement.

Stump Treatment
Some deciduous species may regrow following felling. Where requested, a single chemical treatment may be applied in accordance with manufacturer guidance.
No guarantee can be given regarding the effectiveness of stump treatment due to circumstances beyond our control.
Hidden Defects
Quotations are based upon visual inspection only.
Beechwood Trees and Landscapes Ltd shall not be responsible for hidden defects including decay, cavities, weak unions, embedded metal, unstable root systems, underground obstructions or structural defects not reasonably identifiable prior to commencement of works.
Underground and Overhead Services
Whilst reasonable efforts shall be made to identify underground and overhead services, unless accurate plans have been supplied prior to works commencing, Beechwood Trees and Landscapes Ltd accepts no liability for damage to underground pipes, cables, ducts or other concealed infrastructure.
The customer shall remain responsible for identifying and disclosing service locations.
Any costs associated with temporary removal, isolation or management of utilities shall remain the responsibility of the customer unless agreed otherwise in writing.
Parking, Traffic and Access Charges
Any parking charges, permit costs, suspension fees, clean air zone charges, ULEZ charges, traffic management costs or access restrictions not disclosed at quotation stage may be chargeable in addition to the quoted works.
Measurements
All measurements provided within quotations or correspondence are approximate.
Insurance
All works carried out by Beechwood Trees and Landscapes Ltd are covered by Public Liability Insurance.
Works will be carried out in accordance with good industry practice, site-specific risk assessments and our health and safety procedures.
Copies of insurance certificates are available upon request.

Customer Information and Data Protection
We only use customer information for the purposes of undertaking contracted works and related administration.
We may share information with Local Authorities, statutory bodies or regulatory organisations where necessary for permissions or compliance.

Photographs and Video
Beechwood Trees and Landscapes Ltd may take photographs and/or video recordings before, during and after works for operational records, quality assurance, training, dispute resolution and marketing purposes.
Images will relate to the works only and will not intentionally identify individuals.
If you do not wish photographs or videos to be used publicly, please notify us in writing prior to works commencing.
General
Completion dates remain subject to weather conditions and operational factors.
Quotations remain valid for 30 days unless otherwise stated.
Quotations for felling are based upon the assumption that trees are free from hidden metal, stone or obstructions.
Beechwood Trees and Landscapes Ltd reserves the right to withdraw, amend, postpone or cancel contracts where necessary and shall not be liable for penalties, consequential loss or associated costs arising from cancellation.
Reasons may include diary errors, IT failures, customer error, safety concerns, abusive or antisocial behaviour, changes in circumstances, operational impracticality, third-party restrictions or force majeure events.
