Many people believe that no tree work can be carried out during nesting season — but that’s not entirely true. While UK law (the Wildlife & Countryside Act 1981) makes it illegal to intentionally damage or destroy an active nest, it doesn’t mean all work stops as soon as nesting season begins.

Here’s what you need to know:

  • It is legal to carry out tree work during nesting season, as long as no active nests are disturbed.

  • It is illegal to damage or destroy a nest that is in use or being built.
