Do Arborists Need a Waste Exemption for Chipping?

In April 2025, the Environment Agency (EA) introduced new annual charges for waste exemptions, a move that initially created uncertainty across the arboricultural sector. The changes raised questions about T6 exemptions and whether contractors engaged in chipping wood would now face added costs or regulatory burdens.

After discussions with the EA, the Arboricultural Association has now confirmed that most arboricultural contractors are not affected by these changes, provided they meet specific criteria.

🔍 What Is the T6 Waste Exemption?

The T6 exemption relates to “treating waste wood and plant matter by chipping, shredding, cutting or pulverising.” Under the new rules:

  • First T6 exemption: £420

  • Each additional exemption: £76

At first glance, this appeared to impact tree surgeons and contractors who process wood on site or at their depot.

🌳 Virgin Wood Is Not Classed as Waste

The critical clarification is that chipping “virgin wood” does not require a T6 exemption.

According to the EA, virgin wood refers to:

“Trees and branches resulting from forestry work or management of land, gardens and parks.”

While the term arboriculture is not explicitly mentioned, the EA has confirmed that it does fall under “management of land, gardens and parks.” This includes highways, railways, and all typical arboricultural sites.

Therefore: Arboricultural contractors chipping only virgin wood do not need a T6 exemption.

🚛 Do You Need a Waste Carrier Licence?

Another common concern is whether transporting green waste triggers Waste Carrier obligations. Here’s the rule:

  • If you only transport virgin wood (e.g., branches, tree sections):
    You do NOT need to register as a Waste Carrier.

  • If your work includes fencing, landscaping, or construction elements:
    You may need to register as an Upper Tier Waste Carrier.

It’s your responsibility to review the nature of your contracts and register appropriately if your scope goes beyond pure arboriculture.
